Cooking the Books: Free is good (2009)

The Cooking the Books column from the December 2009 issue of the Socialist Standard

Journalist, broadcaster and author Libby Purves chose the day that the London Evening Standard became a free, give-away paper to launch an attack on the whole idea of people having free access to things. Under the headline “If the future’s worth having, it won’t be free”, she laid into the “internet generation” which “has grown up believing it can enjoy other people’s hard work for nothing. This has got to stop” (Times, 12 October).

We socialists would say that, on the contrary, “if we’re going to have to pay for everything, the future is not worth having”. The resources exist today to produce enough food, clothes, housing, transport and health care so that no one on the planet needs to starve or be malnourished, or go without clean water, or live in slums, or not have access to the medicines and treatment they need. Society could go over to the principle of “from each according to their abilities, to each according to their needs”, with everybody having access to what they need without having to pay in return for contributing what they can to the work of producing what is needed.

This, surely, is a better future than the continued application of the opposite principle of “can’t pay, can’t have” ? Which means that in some parts of the world people die from starvation or easily preventable disease, or exist in shanty towns on the outskirts of big cities. And that, all over the world, most people are deprived of something which would improve their lives and which could easily be provided. Where we can’t build adequate public infrastructures or install anti-pollution technologies because it would “cost too much”.

And what is wrong with the “internet generation” taking for granted that “music, films, news, photographs, cartoons and carefully researched or creative prose” should be available for free? Isn’t this a sign that the money-wages-profit system that is capitalism has outlived its usefulness and perhaps also a sign of the beginning of a consciousness that it needs to be replaced by a system in which people have free access to what they need?

Purves is defending her vested interest as a royalty-reaping author. That’s understandable as, under capitalism, people need money to live and that’s how she gets hers. It might be thought, though, that as a public intellectual she’d be more broad-minded than to judge an economic system by whether or not it ensures her her chosen source of income.

In pleading her cause she goes back to the labour theory of property first put forward by John Locke in the 17th century:
“Content is not cost free. Writing is work. Musicianship involves cost and labour, art is not innately free, nor the infrastructure of news reporting. Until food, clothes, housing and transport are doled out free, content-makers need to be paid”.
And, according to her, the way to ensure this is through “intellectual property rights”, even if these are difficult, not to say impossible, to enforce in some cases.

But she does at least concede that if “food, clothes, housing and transport” were free – which will be the case in socialism – so should watching films or listening to music or reading a book, on the internet. As these will be too in socialism. The future is free.

Invention: A Capitalist Monopoly. (1905)

Recently in a London Police Court an Engineer was charged with stealing two sheets of drawing paper belonging to his employers. The employers, however, were not so much interested in obtaining the paper as the drawings it bore. Property in drawings on paper is not defined by law, but the right to such property has been frequently asserted by enforcing the right to the paper. In this case the defendant had been sent to inspect the exhibits at Olympia Motor Exhibition, and as the result of these visits “at his employers’ directions and expense” he developed ideas for the invention of a new gear box, the rough sketch of which he outlined on paper, “doing his drawing work in his employers’ time, at his employers’ office, with his employers’ materials.” The magistrate notwithstanding discharged the defendant, it being in his judgment “impossible to say that any invention which might earn £1000 a year belonged to those who paid the inventor £3 a week.”

Now this form of property comes under the classification of “Intellectual Property,” and it will be observed that the right to such property is not legally defined, being, as the plaintiff’s solicitor put it, “as in the dark ages.” Neither did the magistrate give judgment in favour of the defendant as a matter of principle, but solely in consideration of the comparative insignificance of his salary.

Why is the right to intellectual property so ill-defined? Lafargue, in an admirable little pamphlet entitled Le Socialisme et Les Intellectuals touches upon this subject. He says :
“Material property, whatever may be its origin, is declared eternal by capitalist law : it is assured for ever to its possessor, handed down from father to son until the end of time, no power, civil or political, being able to lay sacrilegious hands upon it.

“Capitalist law has none of these considerations for intellectual property. Literary and artistic property, the only forms which the law protects, have but a precarious duration, limited (in France) to the life time of the author, and to a certain period after his death; 50 years according to the latest legislation. This moment passed, the right succumbs and falls in the public way : so that from March of the present year (1900) publishers can enrich themselves by publishing the works of Balzac, the genius of romantic literature.

“Literary property, if of importance to publishers, in reality not a very numerous class, does not yield any profit to the capitalists as a whole; but it is not thus with the property in inventions, which is of supreme importance to the industrial and commercial capitalists together. Likewise the law extends no protection whatever to it. The inventor, if he desires to defend his intellectual property against the bourgeois plunderers, must begin by buying this right by taking out a patent, which must be renewed annually. One day behind time in paying the tax, his intellectual property becomes the legitimate prey of the capitalist robbers. Even while paying this sum regularly his right is limited to 14 years (in France). During this short number of years, generally insufficient to have his invention completely adopted in practical industry ; it is he, the inventor, who at his own expense must put the legal machinery against the bourgeois plunderers who would seize it.

“The ‘trade mark,’ which is a form of capitalist property, never having demanded any intellectual effort, is on the contrary indefinitely protected by law like material property.

“The capitalist has only grudgingly granted to the inventor the right to defend his intellectual property, because by his right of reigning class, he believes himself master of the fruits of intellectual labour as well as of manual labour, just as the feudal lord arrogated to himself the right of possession over the property of his serfs.

“The capitalist-class, the most revolutionary class that has ever oppressed human society, cannot increase its riches but by incessantly revolutionising the means of production by the never-ending introduction of new applications of the mechanical, physical, and chemical sciences to the industrial tool. Its thirst for inventions is so insatiable that it has created factories of inventions. Several American capitalists have associated in organising at Mungo Park, for Edison, the most marvellous laboratory in the world. Here they have placed at his disposition an army of scientists, the aristocrats of labour, and the material means necessary to make and continue making the inventions that the capitalists patent, exploit, or sell. Edison, who is himself one of the sharpest of business men, has, however, taken precautions in order to insure his participation in the profits which the inventions of Mungo Park will yield.

”But all inventors cannot, like Edison, impose their conditions on the capitalists who build factories of inventions to exploit them. The Thompson-Houston Company at Paris, Siemens in London and Berlin, have, side by side with their electrical machinery, workshops and laboratories where engineers are engaged in research work, seeking new applications of electricity. At Frankfort in the factory of aniline colours, the largest in the world, and where the mineral antipyrine was discovered, there are more than one hundred chemists paid to discover new chemical products. Each discovery is immediately patented by the firm, which, by way of encouragement, gives some reward to the inventor.

“To a certain point we can consider all factories and workshops as laboratories of inventions, because a considerable number of improvements in machinery have been found out by the workmen in the course of work. As the inventor has not the necessary money to patent or apply his discovery, the employer takes out the patent in his own name, and thus, as bourgeois justice wishes it, it is he who gathers all the accruing profits therefrom. When the government thinks of rewarding talent it is the employer who is rewarded; the workman inventor, who is but an “intellectual,” continues toiling on as before, and as in this capitalist world one must be contented with little, he consoles himself in his misery, saying that his invention brings profit and honour to his master.

Pathfinders: Fancy a chat, GPT? (2023)

The Pathfinders Column from the April 2023 issue of the Socialist Standard

The current tech buzz is that an AI language module called Chat Generative Pre-trained Transformer is threatening to turn global industries almost upside-down. OpenAI launched ChatGPT in November 2022, Microsoft announced a $10bn investment in January this year, and by February it was valued at $29bn. This prompted Google bosses to hit the panic button and reassign tech staff to the urgent task of developing an AI competitor, now hurriedly launched as Google Bard.

ChatGPT is causing a fuss, to put it mildly. Chinese universities have banned it, and the UK Guardian newspaper is calling for government regulation (bit.ly/3FmOSrs). It doesn’t just write plausible academic essays in seconds, it can write commercial copy, speeches, song lyrics, film scripts, poems, music, and computer programs. You name it, basically.

These chatbots don’t work like an ordinary search engine, which looks for exact matches to spit back at you. Instead they use statistical analysis to shape their output based on what and how (they think) people most commonly write, and by extension what they believe, rather than on objective accuracy. This could have implications for socialists. For example, if 90% of sampled text thinks ‘socialism’ means Hitler and Pol Pot, the chatbot will think so too. However, it seems that AIs can be surprisingly even-handed, and often show a liberal or left-wing rather than conservative bias (bit.ly/3Jl2Viw). But they can also get facts embarrassingly wrong, as Google Bard did recently (bit.ly/3YXa3aI). This is worrying when you consider that medical AI chatbots are in development (bit.ly/3FAfZiY). Mental health services have already been criticised for using them (bit.ly/3n584nt).

You can try ChatGPT yourself, by signing up at chat.openai.com/auth/login. You could ask it, say, to compose an ode to your lustfully intended in the style of Byron or Keats, make up a bedtime story for your kids, debug your computer code, or give you a cheat-sheet on dialectical materialism. Some intrepid socialists have already quizzed it on socialist theory, as they discuss on our Forum (bit.ly/3TdlWrN). They conclude that it’s not terrible, and actually gets quite a lot right, if not everything.

To give you a taste, further down this page is a ChatGPT-generated ‘poem’ about abolishing money, and a short essay in response to the request ‘write an article in the style of Pathfinders in the Socialist Standard’. As you’ll see, the poem is a somewhat McGonagall-esque paean to barter systems, while ‘Pathfinders’ is a waffly and generic exercise showing that when it doesn’t know something, it hedges its bets. But still, not terrible. Then the AI does something distinctly odd. It produces an alleged quote from the Socialist Standard which is almost certainly made up, before ending abruptly with a network failure, as if it’s developed a migraine.

In response to the question ‘Do you ever invent quotes?’ ChatGPT gives an interesting answer: 
As an AI language model, I do not have the capacity to invent quotes on my own. However, I can generate quotes based on patterns and combinations of words from my training data, which includes a vast collection of texts and speeches from various sources. However, it is important to note that these generated quotes are not necessarily attributed to any specific person or source, and they should not be taken as fact or used as a source of reliable information.
In other words, it does invent quotes, but because it has compiled the words from multiple sources, it does not consider the quote to be an ‘invention’. Moreover, it will mine these sources from anywhere, without bothering about attribution. This point is actually the cause of a huge global controversy. GPT doesn’t care who authored what, it’s all just ‘training data’. In short, it ignores intellectual property rights, a core concept that underpins capitalism.

ChatGPT slurps up vast volumes of information and serves it back up in spaghettified form with no regard for original sources, a process one incensed artist describes as ‘automated intellectual asset-stripping’ (bit.ly/3n2PlZH). Fine artists and graphic designers have good reason to be worried (as an example, see a set of AI paintings done in the style of Van Gogh here – bit.ly/3LzE3Gj). ChatGPT is a language module, so it doesn’t paint pictures, but instead appropriates the output of the entire news and creative media industry, including novelists, writers, bloggers and journalists. How comprehensively these assets are being stripped may be judged by the fact that AI chatbots are predicted to hit a ceiling in 2026 as they run out of training data (bit.ly/3yRE1lU).

Google is currently in a spat with the Canadian government over the state’s insistence that AI-generated news stories should be paid for, to which Google has retaliated by censoring news outlets from Canadian search results (bit.ly/40gXuIj). More legal wrangling will undoubtedly ensue globally, but there’s no putting this genie back in the bottle. When disruptive technologies collide with capitalism’s own practices and priorities, it’s the disruptors that usually win. And this one is striking at the beating heart of the system, the sacred institution of private property.

One might be tempted to see this as a spanner that could wreck the machinery of the profit system, but capitalism is nothing if not adaptable. And besides, it’s worth asking whether a creative artist, even in socialism, would be comfortable seeing their own work hijacked, dismembered, and then served up piecemeal without their contribution ever being acknowledged. Democratic common ownership is far preferable to capitalism’s squalid property wars, but still, that surely doesn’t make plagiarism ok.

Correction
A new finding this month overturns what was stated in the March Pathfinders column. A re-examination of the study data reveals that the happiest people do in fact continue to get happier above an income level of $75,000, it’s only the most unhappy high-earners who don’t (bit.ly/40gQqLQ). You’ll certainly be relieved to know that the rich are having a good time after all.

Party News (2007)

Party News from the March 2007 issue of the Socialist Standard

On 30 and 31 January Comrade Miller of Central London Branch gave two talks hosted by the Edinburgh and Glasgow branches, respectively. Both talks were on the subject of intellectual property and Free Software. The Edinburgh talk was attended by about 15 people, over half of them first-time visitors. Many of the visitors were avid users and developers of Free Software, and the talk was followed by a long and generally positive discussion. The Glasgow talk also had a similar-sized audience, with two visitors.

Comrade Miller began the talk by introducing and comparing the concepts of physical property and intellectual property (IP), explaining how the law treats them much the same despite the fact that IP requires practically no labour to reproduce and does not spoil or wear out. The primary purpose of laws preventing people from copying music, software, literature, and other information, then, is to effect an artificial scarcity which helps secure profits for IP owners.

Comrade Miller explained how independent software developers, angry with the restrictions imposed by commercial IP owners, began to voluntarily license their software copyrights under terms which guaranteed that the software would always be free for others to use, study, copy, and modify. Since most new software is created by refining and combining existing pieces of software, this licensing scheme essentially returned control of the means of production of software to the community.

The Free Software licencing scheme has since been popularised and adapted to other forms of IP, most notably artwork and literature. Comrade Miller examined as a case study Wikipedia, a large online encyclopaedia which is collaboratively edited by thousands of volunteers from all over the world. The facts that editors contribute voluntarily and without compensation, and that the project operates in a largely democratic fashion without a government, serve to refute the common anti-socialist argument that people will not work and cooperate without coercion.

Though Wikipedia and other free content projects are not socialism, they are illustrative of how certain aspects of socialism could operate. If the artificial scarcity capitalism imposes on physical resources were abolished, as free licensing has done with certain informational resources, then what would be left to stop us from running the whole world through voluntary labour and free access?

Pathfinders: The Tomorrow People (2006)

The Tomorrow People

Future society will be populated by very special people. Within their ageless bodies will exist rejuvenated organs cloned from versions of their cells that have been made younger; youthful hearts and youthful lungs that will beat and breathe forever. Beneath their skin will scamper nanobots: blood-cell sized robots which, like highway maintenance vehicles, will rove their bloodstreams destroying pathogens, removing waste, correcting errors in DNA and reversing the ageing process. The same tiny machines will also enable brain-to-brain communication – telepathy of sorts – via the internet and ensure a vast expansion in human intelligence. Arguably, those special people may become less human as their bodies merge with a technology so advanced that it gradually begins to exceed and replace mere flesh and blood. At least, that’s the prediction of Ray Kurzweil, a Massachusetts-based inventor and writer, in his article ‘Human 2.0’ (New Scientist, September 2005). As is all too common with techie gurus, he has only the vaguest concept of political realities, so it doesn’t occur to him to question whether the future in question will be capitalist or socialist. If Kurzweil even grasped the difference, he probably still wouldn’t understand why the question was relevant. He observes certain anti-progressive tendencies in modern society, and ascribes them to some anomalous general human behaviour, rather than class, specifically capitalist class, behaviour. Consequently he proffers dire warnings about what we ought to do with our collective human knowledge, without ever addressing why we, the vast majority, are not in a position to control or determine what is done with that knowledge. Those of us who take an interest in the scientific adventure feel frequently piqued at the tendency of ‘futurologists’ like Kursweil, Toffler et al to overlook the fundamental political issues arising from the fact that human society is class-based. Scientists can be very far-sighted but at the same time have only a very narrow field of view, like a blinkered racehorse. Still, given our interest in the implications of science for a future socialist society, his predictions are interesting nonetheless and could be seen as relevant to it.

Ray Kurzweil is a pioneer in the fields of optical character recognition (OCR), text-to-speech synthesis, speech recognition technology, and electronic musical keyboards. He is the author of several books on health, artificial intelligence, transhumanism, and technological singularity. He is also an enthusiastic advocate of using technology to achieve immortality. He predicts that ‘we won’t experience 100 years of progress in the 21st century – it will be more like 20,000 years of progress’ due to exponential rather than linear techological change which will result in the Singularity, ‘technological change so rapid and profound it represents a rupture in the fabric of human history’ (http://en.wikipedia.org).

The concept of a singularity, a new technological ‘big bang’, is an exciting one, and Kurzweil is clearly very taken with it. It is fairly obvious that science does not progress in linear fashion, like a train along a railway, but in geometric fashion, doubling and doubling again. Revolutions in science are almost a weekly event these days, and it is therefore not hard to imagine a ‘super-revolution’, a point where the whole of human society has to change very suddenly. In a way, a socialist political revolution is almost implicit in such an event, as the fetters and restrictions of outmoded social practices are blown to pieces in a matter of days or weeks by the devastating power of the singularity.

Of course, he could be wrong. There may be no singularity, despite all the indications. Alternatively, the powers that be might be able to prevent or limit it. You don’t get rich by giving things away for free. There is every reason to suppose, for example, that nanotechnology, one very likely factor in causing the singularity, will be strictly controlled and limited, a bomb kept in a concrete box.

Tellingly, Kurzweil comments that ‘to proscribe such technologies will not only deprive human society of profound benefits, but will drive these technologies underground, which would make the dangers worse’ (New Scientist, September 2005).

It’s not difficult to see how the proscriptive tendency of capitalism, governed by the rule of production for profit not need, could put a dampener on Kurzweil’s technology-enriched version of humanity. If such technology does come onto the market, to whom will it be available? All of humanity without exception, as Kurzweil perhaps hopes, or only those wealthy enough to afford it? After all, it is likely to be expensive treatment, making its beneficiaries not only economically superior, but genetically superior also. Yet another proscriptive tendency is intellectual property right (see Patent Absurdity, and also ‘Intellectual Property: a further restriction on personal freedom’ for a fuller discussion of this subject).

Kurzweil likes to define humans as ‘the species that seeks – and succeeds – in going beyond our limitations’. But we will really start making some progress when the scientific community succeeds in going beyond its own limitations, and recognising the political dimension of the human project. Many scientists individually seem to understand the restrictive and anti-progressive nature of current practices, but somehow assume that explicit political positions are outside their remit, or even beneath them. In fact, all humans take a political position, whether they admit it or not. Science does not sit in a rarefied world above politics, it is part and parcel of it, and scientists who care about the world’s future ought to have the courage and honesty to declare themselves, and stop worrying about peer-group pressure. It’s not the professional suicide it once was. If you oppose the restrictive practices of capitalism, then you oppose capitalism. It doesn’t take an Einstein or even a Kursweil to work out what that means.


Patent Absurdity

Patent and copyright laws exist to ‘protect’ their authors and to provide a profit incentive to develop new ideas and technologies, according to the lobby which advocates strengthening patent law. But this lobby generally consists of large companies who have zealously bought up libraries of patents in order to lock out competitors, while the opponents of patent restrictions tend to be small companies unable to get a foot in the door, and who argue that such restrictions hold back development.

Human Genome Sciences of Maryland are well known for patenting much of the human genome, and once tried to patent one of the bacteria that causes meningitis, while Incyte Pharmaceuticals of Palo Alto, California own the patent on Staphylococcus aureus, a species whose study is crucial because it is known to evolve resistance to antibiotics (New Scientist, May 16, 1998).

An independent commission on intellectual property rights reported in 2002 that the World Trade Organisation were strong-arming developing countries into signing intellectual property rights (IPR) agreements which were of no benefit to them, because they had very little to patent, but instead force up prices and inhibit technology transfer. The report concluded that IPRs effectively rip off poor countries (New Scientist, Sept 21, 2002).

The issue of patents is always going to be thorny, because both arguments are correct – in capitalism. Ownership of intellectual property has to be protected in a property owning society, as anyone who has had their house burgled, their car stolen or their idea robbed will tend to agree, but there is no denying that intellectual property rights do indeed stifle innovation in every field, because of the tendency of patents to concentrate into the hands of the intellectual property rich. The scientific community is divided on the question, between those who believe in knowledge for its own sake and therefore wish to pool ideas, and those who wish to profit personally from their research by denying others access. Since this is precisely the same debate as between socialists and those who support capitalism, one might describe scientists who wish to abolish patent and copyright restrictions as closet socialists.

Capitalism and computers (1994)

If you’re busily looking around at what political parties propose to do about the world we live in, you’ll notice that it’s very hard to get them to come clean and tell you their whole programme. They will say that is because you can’t explain a whole political programme in a sentence. I say that if you can’t explain your objective in a sentence it's because you haven’t got one. The Socialist Party objective is highly controversial, but it's very straightforward: the abolition of private property. It’s not that we oppose capitalism and would like to have some other arrangement of the property laws. It’s not that we hate money and prefer direct bartering of property. We oppose the concept of property ownership itself, and everything it entails.

Now why should property be such a problem, you might ask. Surely all our problems derive from not having enough of it in the first place? Don't we spend all our lives dreaming of the Pools? How does getting rid of all money and private property solve anything? We want more of these things, not less.

In answer allow me to refer you to interesting developments in the computer industry by way of analogy. In the world of computers, information can be privately owned, and therefore bought and sold, just like tins of spaghetti. Now I must point out that unlike other commodities such as spaghetti it is possible to steal information without its owner being aware of the theft — the shelf stocks don’t shrink from pilfering because you don’t actually physically take anything. You simply copy it. And if you’re copying it, you're not buying it. So the information tycoons get ripped off (shame) by invisible tealeaves who hardly ever get caught. Question: What can they do? Answer: Take you to the cleaners if they do catch you, otherwise not much.

Software piracy is now a criminal offence and is covered by the copyright laws. So if your boss at work asks you to copy an unlicensed program for the company, or use a program that you know has been copied without a license, you personally can also get prosecuted. So tell the boss to fuck off, unless he's going to make it worth your while to break the law. And incidentally, disgruntled ex-employees reading this will be interested in the potential for dropping their old employers in the shit. The fines can be ginormous. Not that I would encourage fellow workers to be spiteful, you understand . . .

But all that only applies to direct bit for bit mechanical copying. Alternatively, suppose you rewrote a program in your own code, in such a way that it did exactly the same thing as the original commercial program, and you then sold the finished item as your own program? In other words, you haven't copied it, but you have created an exactly similar replica. Maybe it sounds improbable to have to reinvent the wheel like that but it’s called reverse engineering and it goes on all the time. Only the twisted logic of a money-driven society could come up with anything quite as stupid as this, but there you go. Much of what passes for research in many different industries is simply company scientists being paid to reverse engineer other companies’ ideas. You wouldn't be breaching copyright, but you would still have pinched someone else’s idea and used it to make a profit. So how do you stop that? In theory, by holding a patent. However, you can’t rely on them.

In a recent patent dispute Intel the chipmakers tried to sue a rival company, AMD, for reverse engineering the 80386 and 80486 series of chips. AMD were of course guilty as hell. In fact they didn’t deny it. They won the case on the basis that reverse engineering didn’t breach Intel’s patent restrictions and that besides you can't copyright a number. So they effectively stole the whole thing, name and all, and got away with it. Intel retired sulking over their lost case, eventually emerging to retaliate with dash and brilliance by calling the new 80586 the 'Pentium'. On a different note, we can no doubt look forward to the Sextium, or maybe they’ll change its name to 'Esprit' or perhaps just 'Roger’. You think I jest? I make schoolboy joke? Let me tell you, an industry that calls a binary number an item of 'underwear' is capable of anything.

I digress. Now it happens that once upon a time the Patent Office didn't grant patents for computer algorithms at all, arguing amongst other things that it wasn't possible to call a string of numbers in a file (all that a program really is) an invention. In the 1950s through to the 1970s, unhampered by patent restrictions, research borrowed freely from research, and computer software developed very rapidly during this period as a result. It was an exciting period to be involved in computers, and all the real landmarks in computer technology were established at this time: spreadsheets, word-processing and DTP, computer aided design, networking, real-time simulation and virtual reality. The only thing that looked more exciting than the present was the near future.

However, things changed. During the 1980s patents started to be granted, sometimes for ridiculous things which were not original at all. The Patent Office arguably couldn’t keep abreast of fast-moving changes in this sunrise industry and tended to believe what it was told. And then the problems began.

If you can gull the Patent Office into granting a patent for your code, then whenever anyone writes any program that uses the same idea, they have to pay you royalties. So what big software houses are doing now is buying up buckets of patents and using them to sue the arses off all their competitors as a way of slowing them down — because it ends up being impossible to write any code at all without being in breach of somebody’s patent. As one observer puts it, in today’s information superhighway the Patent is what gets you pulled over for speeding (New Scientist, April 23).

The problem is, ownership of ideas slows down development of new ideas across the board, and in every field of computer science, and by extension in every field of human endeavour. Research is now hag-ridden with lawsuits. Nobody dares do anything innovative for fear of being stomped on by the big bullyboy patent owners. The result is that progress grinds to a halt, or shifts phase into that monumental waste of effort known as "lateral" or "sideways development", which is a process of designing the same thing over and over again in different fashion shades. You see what I'm getting at here? Private ownership has avalanched into the vale of ideas and dammed up the river. So the computer world is fiercely divided now between the rich software houses with their libraries of patents and their conservative views, and the rest who are clamouring to abolish the patent system. In other words, abolish the right to "own" an idea by patent, and you can at one stroke emancipate computer research and people can once again start to do really interesting things with the technology.

Anyone familiar with the Socialist case will see the similarity between the two arguments immediately. They are saying that ownership of ideas halts the progress of ideas. We are saying that ownership itself halts human progress of almost any sort. The scientists complain that they can’t have free access to ideas. We complain that humans can’t have free access to even basic necessities like food and shelter. The upshot of both arguments is the same — how are we supposed to progress as a civilisation under such restrictions?

In actuality the progressive scientists are not being as revolutionary as all that. Even if the state agreed to abolish the patent system — perhaps in order to stimulate the sagging computer economy — that doesn’t mean that suddenly information would become free. Those scientists would still be happy to make us pay for their ideas — they just wouldn't have to pay themselves. But the probability is that they won’t get their way. The reason that you can "own" an idea is that capitalism is a system of "ownership". It tends to commodify whatever can be made into a commodity, however unlikely. If you can figure out some way to stop everybody getting at it, then you can force them to buy it from you as a commodity, on a market established for that purpose, and at a massive rate of profit.

Example: why isn’t air a commodity while water is? Because they haven’t figured out how to restrict our access to air yet, but god help us all when they do. You see, the money system depends on stopping you from getting what you want. Now you see we are having to pay for metered water, even though it rains for eleven months of the bloody year, because they "own" the purification plants. A thing doesn’t have to be rare or scarce to be a commodity. It just has to be rendered unavailable by careful containment.

So all that’s happened in the computer industry is that information has been commodified. There should be no surprise about that, and no real expectation of being able to return to earlier times. You can’t seriously expect owners of a commodity like information to allow you to decommodify it from under them. Not unless you were actually challenging the concept of property ownership itself, the whole basis of capitalism, in which case we’d be talking world socialist revolution.

So hard cheese to the computer scientists. And anyway, what makes them think progress is on the agenda in the first place, or that "pure" research is or ought to be somehow exempt from the property system? They really do become insufferably pious and moral at times. There’s only one item on the agenda of anyone who owns anything in this world, and it begins with 'M'and rhymes with funny. Ingenious though I think computer researchers frequently are, I just can’t figure out where they get this idea from. Too much staring at the screen makes you go blind, perhaps.

Growing Old Disgracefully

A feature often commented upon by historians, is that before private property societies existed the elderly of a kin, clan or tribal group were treated with great respect. Their knowledge of the terrain, animals and availability of food was invaluable to their society. How different today in modern capitalism. “The government is abandoning hundreds of thousands of elderly people to a care system that steals their dignity, denies them meaningful choice and risks endangering their health, according to a hard-hitting report out tomorrow. The report – by the country’s leading independent healthcare thinktank, the King’s Fund – concludes that funding and organisational problems are putting old people at a disadvantage compared with other recipients of care. It also says that untrained, unqualified and overstretched staff are putting them at risk.” The Observer (26 June) Let’s face it inside capitalism old-age sucks. Although all those social workers forced to make these decisions will themselves be old one day.


Moral Considerations

The growing practice of scientific journals to copyright and restrict access to scientific data without cash subscriptions has led Robert Smith, a former editor of the British Medical Journal, to raise a moral dilemma. “Making money out of restricting access to (medical) research is immoral.” The Times (2 July) In fact Mr Smith you are terribly wrong, inside capitalism it is not only moral but good business practice. Only inside a socialist society will we have unrestricted access to knowledge for every human being on earth. People dying because medical personnel couldn’t access the latest scientific knowledge would be unthinkable inside a socialist society. It is quite moral today.


The Grapes of Wrath

In any sane society an abundant harvest from the vineyards would be the cause of celebration and no doubt a little celebratory tipple. But we don’t live in a sane society, we live in capitalism where the whole purpose of production is to make a profit not satisfy a social need. “It may seem heinous to any enthusiastic bordeaux drinker, but the EU has pledged £100m under the common agricultural policy to turn 670m bottles of French and Spanish wine into industrial alcohol to help reduce a surplus caused by competition from the New World.” The Sunday Times (3 July) Inside a socialist society if we produce too much wine we’ll just have to drink it. Terrible prospect, aint it?


An Investment Opportunity
The callousness of capitalism and the cynicism of the capitalist press could hardly be summed up better than this report about the bomb carnage in London that left over 50 dead and scores wounded. “City Index, the financial spreadbetting firm, said that more than 8,000 retail investors had dived into the market on Thursday, correctly backing their hunch that share prices would quickly bounce back. Some will find profiting from horror distasteful. But many in the City applaud the resilience of capitalism.” The Sunday Times (10 July) The editors carried this story under the headline – “Investors made millions amid bombs chaos.” Could anything be more disgusting? We are talking about trauma, amputation, disfigurement and death here not an investment opportunity.


Dare To Think

“A penniless asylum seeker in London was vilified across two pages of the Daily Mail last week. No surprise there, perhaps – except that the villain in question has been dead since 1883. “Marx the Monster” was the Mail’s furious reaction to the news that thousands of Radio 4 listeners had chosen Karl Marx as their favourite thinker.” The Observer (17 July) Many people who read the works of Karl Marx realise that the popular concept that he has anything to do with Lenin, Trotsky, Stalin or Mao is nonsense, in fact that he was opposed to dictatorship and authority all his life. Start reading what Marx actually wrote and accept his challenge to think for yourself and bugger the Daily Mail.

ESA’s eggs in one rocket

One gets so used to warnings of woe and dire prognostications that the occasional ‘good news’ item really stands up and waves with both hands, and lately there have been more than one such item. We have recently learned, for example, that the disaster attending the melting of the West Antarctic ice sheet might not be so bad after all (‘Ice sheet melt threat reassessed’, BBC Online, 14 May). No indeed, instead of the sea level rising by six metres, it may only rise by three. This may not comfort the sub-sea-level Dutch, who can’t afford a rise of three centimetres never mind metres, but you might be able to get by living on the first floor of your house and punting to work. Heartwarming news, too, that some species of insects are not as threatened with extinction as previously believed. “We were a bit surprised that the dragonflies are not that bad off”, says one researcher (‘Dragonflies face uncertain future’, BBC Online, 15 May). Entomologists probably won’t be partying while Rome burns for mammals, birds and amphibians, who make up 63 percent of threatened species. It’s just amazing that the Grim Reaper – that Horseman of the Apocalypse known as ‘Capitalism’ – has been so remiss as to overlook something.

Rather more inspiring news for astronomer buffs came with the successful lifting off of the Herschel and Planck space telescopes on an Ariane 5 on 15 May. Herschel is an infra-red telescope that will see through gas and dust clouds to observe stars and galaxies being born, while Planck will study the Cosmic Microwave Background radiation, key to unlocking the secrets of the Big Bang and the proposed Inflation event, and perhaps even finding hints of earlier universes. The holy grail of grails would be to find experimental evidence of the ‘multiverse’, the supposed multiplicity of parallel universes predicted, or rather unavoidably encountered, by string theory. This might then suggest that physics has not, as some suspect, been wasting its time for thirty years tunnelling down a hopeless blind alley.

Easily the most expensive projects undertaken by the European Space Agency, these telescopes were bundled together on one rocket (which has been known to explode) for economy’s sake. So were the scientists nervous at take-off? You betcha. It wasn’t just the prospect of a £1.7 bn firework display, it was the gambling of a huge time investment by hundreds of people. “I woke up at 4.15am this morning, I was so nervous”, said one Cardiff astrophysicist. “Some people have spent 10 years and more on this …. I felt sick to the stomach.”

And it wasn’t just past effort that was riding on the launch. “If this were to have blown up… a lot of people could have lost their jobs and grants and funds coming for it would have gone.” (‘Jitters and joy at rocket launch’, BBC Online, 14 May). As a bonus, Cardiff University looks forward to seeing a big boost in undergraduate admissions as a result of their involvement in the ESA project. In capitalism, even in pure science, there’s always an angle.


Patent Stupidity

Imagine getting cancer and being told that you can’t have a cancer test because one of the genes involved in the cancer belongs to a private company. This is what happened to Genae Girard of Austin, Texas, in 2006, when she ran up against a patent owned by the company Myriad Genetics. Now, with the backing of other cancer patients and professional groups of pathologists, she is suing Myriad and the US Patent Office (‘Cancer Patients Challenge the Patenting of a Gene’, New York Times, 12 May). At stake is the question of whether it is legitimate for companies to own natural processes. Yes, say companies like Myriad, who wish to charge patients like Girard $3,000 and who refuse to work with their health insurers. Yes, says the Patent Office, who argue that patent restrictions encourage technological development. No, say a host of researchers, who argue the precise opposite, that patents limit research and result in mediocrity and stagnation. Other companies say they can do the same work as Myriad, faster and cheaper, but are legally prevented from doing so. Though one patent-owning company drew praise by being generous with free licensing, this is not likely to be the norm, and future research involving the crossing of multiple patent walls will most probably founder. Many scientists are simply outraged at this imposition of market values on the quest for knowledge. For them, the future of science is in the balance. “You can’t patent my DNA, any more than you can patent my right arm, or patent my blood,” says Jan Nowak, of the Association for Molecular Pathology. But in capitalism, you can own anything, no matter how much it flies in the face of common sense and common interest

We can only hope that the next bit of good news is that someone has patented the swine flu virus. That way, none of us will be allowed to catch it.


Lawfare and Disorder

While litigators across the Pond battle over intellectual property rights, litigation over in the UK seems bent on abolishing intelligence. The well-known enthusiasm among member states of the Organisation of the Islamic Conference (OIC) to pursue libel suits against Western newspapers and individuals seems now to have spilled over into junk science. Using libel law to prevent and punish unwelcome criticism is known as ‘lawfare’ and even ‘libel terrorism’, and is a standard tactic for the OIC, but now snake-oil merchants everywhere will be ecstatic that the British Chiropractic Association has won its libel case against the science writer Simon Singh, who described certain of its practices as ‘bogus’ (New Scientist, 16 May). This victory may owe a great deal to the fact that, in English libel law, the burden of proof is upon the defendant, not the prosecution, a peculiarity which has spawned a UK-centred ‘libel tourism’ industry. Now the homeopaths and crystal-therapists will be catching on. You don’t need to prove that your ‘alternative’ homespun voodoo works, you can just rely on the defence being unable to prove that it doesn’t. Were we to claim in the Socialist Standard that fairies don’t exist, we would nonetheless have a hard time proving it.

Cooking the Books: Not applying technology (2019)

In his book Fully Automated Luxury Communism Aaron Bastani quotes the US economist Paul Romer’s definition of technological change as ‘an improvement in the instructions for mixing together raw materials’ (he meant physical materials). He summarises Romer’s conclusion as that ‘over time, as technology develops, the value increasingly arises from the instructions for materials as opposed to the materials themselves’.

This is similar to what Marx, in ‘The Fragment on Machines’ in the Grundrisse, had said would eventually happen, with general scientific knowledge becoming a more important factor in production than direct labour. As this knowledge is a social product it’s an additional argument for socialism.

According to Bastani, Romer made the further point that ‘once the cost of creating a new set of instructions has been incurred the instructions can be used over and over again at no additional cost’. In other words, these instructions, once developed, could be available to be used for free in much the same way as digitised articles, books, films and music can be.

But there is a snag, as Bastani noted. This knowledge is privately owned and only made available by the developers to others at a cost – the royalty payments for the use of the patent. Some is even kept as a ‘trade secret’. Patents and other so-called ‘intellectual property’ rights are merely a legal fiction, applicable solely because they are entirely the product of a legal enactment, enforced by the courts and, ultimately, by the coercive power of the state.

Property rights over material goods are also a legal fiction, though not as blatant, as people can imagine more easily material goods being possessed in the absence of legal backing. On analysis, however, property in land, factories and other means for producing material things is not the same as physically possessing them. The owner of a landed estate does not physically possess the land in the same way that they possess their clothes or their car; nor does a capitalist shareholder. Their property rights have also been created and are enforced by the state.

The fact that scientific and technological knowledge has developed to the point where it could be applied to produce enough for everybody to be able to satisfy their material needs strengthens the case for socialism. It confirms that, whereas capitalism has developed the potential for this, it is incapable of activating it for the benefit of all. Capitalism has solved the problem of producing enough for all, but cannot distribute it. Only socialism can do this, on the basis of production directly for use, not profit, and distribution according to needs, not rationing through the wages system.

‘Fully Automated Luxury Communism’, as a description of socialism, is a deliberate exaggeration to dissociate the idea of communism from what happened in Russia with its shortages and queues. But it risks another misunderstanding – that socialism only becomes possible if there is ‘full’ automation. This would mean that it is still not really possible. This in fact is the justification that Bastani (and his fellow FALC advocate, Ash Sarkar) give for supporting the gradualism of the left-wing of the Labour Party. A better term, though admittedly not quite as snappy, might be ‘Highly Automated, Non-Austerity Communism’.

Pathfinders: Acta of Desperation (2012)

Acta of Desperation

One of the more memorable jokes in Douglas Adams’ Hitchhiker’s Guide to the Galaxy was the one about the supercomputer which, on being asked the meaning of life, supplied the answer ‘42’. One of capitalism’s most profound illogicalities is its constant need to render unquantifiable things – like knowledge – in monetary terms so that its bean-counters can do their sums properly. It’s the same joke, only accountants don’t get the laughs.

NASA is pulling out of its agreement with the European Space Agency over the planned ExoMars Rover programme, citing lack of funds. It has already ceased supplying the International Space Station. Given that the ISS is the most expensive thing ever to have been built by human beings, this seems rather like spoiling the spaceship for a ha’porth of tar, but there’s a slump on and the purse-strings are being pulled tight. Science is worth the money, says Barack Obama’s budget, as long as it’s somebody else’s money.

The price of knowledge is being addressed in a different way by the recent signing by 22 countries of ACTA, the Anti-Counterfeiting Trade Agreement, which is the latest international attempt to establish base-line rules for protecting intellectual property rights (IPR). Internet traffic is international but regulations are national, meaning that information – and therefore profit – leaks away everywhere like water from a leaky bucket and national regulators can do nothing about it.

There has been outcry against this agreement, with protests in many European cities. Much of this is youth-based and centred on the idea that information ought to be free. Socialists ought to be sympathetic to this, given that we want everything to be free, but there’s something irritating about people who see no further than the one commodity they’re personally interested in. Instead of being quasi-socialist thinking, it looks like the self-indulgence of privileged young Westerners who don’t know the real meaning of poverty. To someone starving or homeless, they must look like a bunch of rich kids sulking and demanding free sweets.

Despite the surreal appearance of a Pirate Party in Sweden and now in the UK as well, most opposition is not based on some imagined ‘right-to-download’ but on the unarguable truth that, to accommodate the differences between the legislatures of various countries, this agreement is so necessarily general it opens barn-doors to the future enactment of a large array of repressive measures, including those relating to free speech. Pleas by ACTA’s defenders that such measures are not the intention are probably true at this precise moment, but this of course doesn’t guarantee that the thought will never cross their minds in the future. Any legislation which makes repression easier in principle should be opposed on principle.

The ACTA agreement contains provision for the prevention of counterfeit goods too, which, in the case of counterfeit medicines would, in theory, be a very good thing as they are a huge global problem. Whether it is really intended to focus on that market, which largely consists of poor people buying dud drugs because they can’t afford the real thing, or on the lucrative trade in bogus clothing, electronics and DVD brands, which involves flush westerners simply saving a few quid, we leave to the reader’s intelligent guess. It is significant that China doesn’t support ACTA, given that much of this counterfeiting comes from there. China, being a box-shifting manufacturer not a developer, tends to be intensely relaxed about intellectual property laws (see Apple Stuffing).

Against the naive assumption that, alone of all commodities in capitalism, information should be free, should be set the equally naive assumption by ACTA supporters that all ‘stolen’ goods represent a loss of earnings. That piracy costs the entertainment industry money is undoubtedly true, but how do you estimate the value of what people don’t buy? The likelihood is, if piracy were ever truly stamped out, the former pirates would not then happily go out and stump up fifteen quid for a new film or music CD. Instead they’d do without, or wait until it was cheap, and the industry wouldn’t gain much.

What ACTA is really about is not repression but manufacturers desperately trying to raise their profits in the middle of a slump while fending off attempts by poor consumers to undermine them. But other manufacturers can always cash in by doing the opposite. Cheap DVD players are now sold with USB connections, allowing you to play AVI format films from a flash-Rom memory stick. How the film arrived on that stick, and in that format, is a question that we socialists, not being pirates of course, must once again leave to the intelligent reader.


Golden Opportunity

It seems the Tory back-benches are mounting a revolt over the government’s spending on wind energy development, possibly because of the heavy subsidisation costs, or maybe because they don’t want bloody great wind farms all over their Cotswold hunting ranges. The government is committed to increasing wind energy from its present 2.2 percent to 15 percent by 2015, if it’s to keep to its internationally agreed environmental targets. Fat chance of that. More realistically, its keen environmental concern is in not being held to ransom by the Russian gas oligarchs, and there are only so many nuclear power stations it can foist upon us.

Aside from gales-into-gigawatts, alternative energy research is throwing up other possibilities. Interesting research into Microbial Fuel Cells at Bristol UWE recently claimed a world first in proposing urine as a revolutionary new fuel (BBC Online, 9 November 2011). Its stored energy potential may not be particularly high but it is free to collect in large quantities, and may well save on sewerage costs into the bargain. Above all it would then allow us to point out what we’ve known all along, that the state’s environmental energy policy is all wind and piss.


Apple Stuffing

Apple’s trade in China (see this issue) is not without its downside. Apple has just lost a case against the company Proview in a Hong Kong court over the worldwide rights to the name ‘iPad’, which Proview thought of but which Apple claims it bought off them for use in ten countries. Now it is going to a mainland Chinese court, but the Chinese state is going to be nervous about upholding an intellectual rights case on its own turf when it flagrantly violates them over everything else. When you lie down with the dragon you can get your wallet singed.

Higgs Story in the Making

Last month’s big science news, perhaps the news of the decade, was the Higgs discovery, or rather the discovery of a new particle of some sort which may or may not be the Higgs or some relative, close friend, neighbour or chat-room acquaintance thereof. Ask anyone on the street what the significance of this is and they will cheerfully tell you they’ve no idea. The physicists are none too sure either. Their jubilation is due to a twofold success story, the one of theory, the other of experimental ingenuity. Theorists can dream up all sorts of exotic ideas, but testing them is quite another matter. The Large Hadron Collider and its two detectors CMS and ATLAS are probably the most complex machines ever built by humans. They would be a triumph of engineering even if they hadn’t found anything. The discovery doesn’t push back the boundaries of the unknown, nor even positively confirm what is known. Like a man found at a crime scene holding the murder weapon, the particle may look guilty as hell, but so far the evidence is all circumstantial and other interpretations are possible. Even if it cries ‘Fair cop, guv, I’m the one wot done it’, it’s just one gangland boss in a whole shadowy organisation, behind which lurk the elusive grandmasters gravity, supersymmetry (maybe) and who knows what else? The Higgs does not so much expand our collective knowledge as confirm the majestic scale of our ignorance.

Socialists spend a lot of time talking about what capitalism does badly, but it behoves us to acknowledge too when capitalism does something well. Science has been a galloping success and its expansion shows no sign of slowing down but instead is accelerating. It is sobering to reflect that Einstein in his prime had no idea that galaxies existed. The fact that the universe itself, like science, is also expanding and that this expansion is accelerating is a fact now probably known to most schoolchildren, yet it was not known when Tony Blair’s New Labour came to power, and the Nobel prize for this discovery was awarded just last year.

This is one of the most contradictory and confusing aspects of capitalism. It is not just averagely good or bad at doing things, it is amazingly good and bad at doing things. When the history of this epoch comes to be written, perhaps by future socialist scholars, people will scratch their heads over the triumphant success of experimental high energy physics on the one hand, and the utter failure of society to make any progress over climate change on the other. How is it that we could explore, with an unprecedented level of cooperation, cost, accuracy and dedication, the fundamental nature of matter, while managing to overlook the fact that our collective laboratory was burning down around us? Why did we pour such ingenuity into, say, fat research while ignoring mass starvation, or epidemiology while doing nothing to stop the epidemics of easily preventable diseases?

It’s all about the money, obviously. Some might wonder why 111 states, with their eye always on the accounts, ever came to pay £6bn for an experiment which shows no obvious prospect of producing a financial return, especially when these same states show no similar cooperation over climate control. But that is to forget the casino nature of the system. Capitalism backs science like a gambler backs horses, expecting losses but hoping for a few big wins. Nobody has any idea whether or how the Higgs might represent a win in money terms. It may do or it may not. The Caderache fusion reactor (Pathfinders, May 2012) will probably cost three or four times this amount, and may produce nothing. Roughly $150bn has so far been lofted into orbit in support of the International Space Station, with again no certainty of a payoff.

What is certain is that poor people don’t pay, no matter how much research you put in, no matter what experiments you do. Putting food in a hungry child’s mouth is never going to make any sense in capitalism. That horse simply won’t run. Climate control, similarly, is a loser. Collective rationality just doesn’t come into it. Expecting capitalist states to agree to climate control is like expecting trees in a forest not to try to outgrow each other. Whoever cheats will gain an advantage, so everyone must cheat. Even though everyone ultimately exhausts themselves in the effort, nobody can afford to be left behind in the race.

So while we should acknowledge the amazing success of science within capitalism we have to recognise its political context. Its achievements are those which capitalism wants, its agenda that which capitalism writes. Those who support science can sometimes fall into the habit of reifying it as an ideal, as a ‘value-free’ quest for knowledge which transcends all other considerations. For them, the portrait of the astronomer peering through his telescope and writing his notes can never be anything other than a noble vision.  But we are not living in a noble vision and science does not exist in a bubble. Outside the quiet observatory the world is immersed in chaos and murder. For all its monumental achievements, science can never really be true science while it is forced to flow down the channels money cuts for it. And human society will never be truly scientific, no matter how far it pursues the secret facts of nature, while it continues to ignore the salient facts of life.

Ongoing tribulations with capitalism’s attempts to commodify the unquantifiable: knowledge. Now in a major blow to the software industry the European Union has ruled that software companies have no right to prevent customers from reselling old second-hand titles (New Scientist, 14 July). Up to now the software mafia have insisted that knowledge is a hitherto unique type of commodity, where you don’t buy the thing itself but instead buy a licence to use it. Since this militates against most people’s conception of common sense in capitalism, it was widely misunderstood or disregarded. How, people wondered, could you pay for something and still not own it? The new ruling throws out this bizarre anomaly, but it does more than that, for who is to say who’s bought what from whom in the second-hand market? The worst fears of the industry will now be realised, to the delight of users, as we all go around ‘selling’ each other our software for a notional penny. Which we may never get round to paying. It’s nice to see, for a change, capitalism’s efforts to create artificial scarcity being given the bum’s rush.

The Publishers’ League, in a bulletin directed against the tariff on type-setting machines, reports that the Mergenthaler Linotype Co. has bought up over 600 patents, of which about 50 are used, the others being “locked up” for the purpose of perpetuating the Mergenthaler monopoly. Mergenthaler invented the machine. He died in poverty. The concern which “capitalized" and exploited the invention has become one of the strongest monopolies in America.

Socialist Party Statement on the Marx Copyright Controversy (2014)

This spring, London-based publishers Lawrence & Wishart came under fire online and in the leftist press for allegedly trying to ‘privatise’ the works of Karl Marx and Friedrich Engels. By now over six thousand activists have signed online petitions demanding that the ‘nasty, capitalistic’ publishers retract their claim of a copyright ‘monopoly’ over the duo’s collected writings. The allegations make for compelling headlines, but in reality the issue isn’t so clear cut.

The works of Marx and Engels are valuable because they systematically document and explain the basic economic processes underpinning class societies. And an understanding of these processes is vital for identifying the problems with our own class society—capitalism—and what needs to be done to rectify them. Of course, countless later writers have helpfully summarised, elucidated, corrected, and interpreted Marx and Engels’s works, though many of the original writings remain relevant and worthy of study today.

Both men having died in the 19th century, the copyrights on their original publications have long since expired. They are now in the public domain, meaning that, as far as the law is concerned, anyone is free to copy and distribute them. However, this status applies only to the works as they were originally published, unannotated and (usually) in German. Under copyright law, whenever someone produces a new version of a public-domain work that extends or transforms it in an intellectually creative way, such as through editing, critical commentary, or translation into another language, a new copyright is manifested in the novel creative elements. British law fixes the term of copyright at 70 years following the death of the creator, so any translations and critical editions produced since 1944 are likely to be proprietary in the UK.

The recent furore over Lawrence & Wishart began when they demanded that the Marxists Internet Archive, a free online library, stop distributing material from a particular modern collection with the title Marx/Engels Collected Works. This collection is a 50-volume scholarly edition and English translation which Lawrence & Wishart had commissioned themselves (in collaboration with two other publishers) between 1975 and 2005. Though as a matter of law the publishers have the right to restrict republication of their own particular edition, their detractors have misunderstood this to mean that Lawrence & Wishart were asserting complete economic control over all of Marx and Engels’s works generally. In reality, the original German texts upon which the Collected Works is based, as well as many earlier English translations and editions of these same texts, remain in the public domain.

Certainly the Socialist Party would welcome a move by Lawrence & Wishart to release their Collected Works into the public domain, or under terms which would permit the Marxists Internet Archive to resume distributing it. But at the same time it is understandable why they have so far opted not to do this. Like any other private enterprise marketing a product, their very existence is predicated on their exclusive control of the fruits of their employees’ labour. It is illogical to attack a single commercial publisher for engaging in business practices which are, by economic necessity, no different from those of every other one.

What we can do, and indeed what we have always done, is to roundly condemn the entire socio-economic system which has led to the repugnant concept of  ‘intellectual property’. Not long ago the notion that anyone ought to be able to claim exclusive rights to the expression of an idea would have been considered absurd. Today, however, legislative and technological measures have enabled and entrenched the commodification of humanity’s intellectual output. While computers and the Internet have long since made it feasible to freely share the totality of the world’s knowledge, the realisation of this has been thwarted at every turn by those whose business models require that information, like physical commodities, remain scarce. In the digital world, of course, information is never scarce—entire libraries can be duplicated a thousand times over with the click of a button. Rather than face up to this fact, publishers have collectively erected artificial legal and technical barriers to the distribution of knowledge. Here, as elsewhere in capitalism, technological progress and social utility take a back seat to the preservation of profits.

The fundamental problem with the removal of Marx/Engels Collected Works from the internet, then, lies not with Lawrence & Wishart’s demand, nor with the bourgeois copyright regime which gave it legal force. Rather, it is with the capitalist mode of production in general, in which nothing—not even scholarly editions of socialist texts—is produced unless it can be sold at a profit. Capitalist businesses which are not willing to take such legally sanctioned but antisocial steps as are required to preserve their profits are doomed to fail, only to be supplanted by competitors with no such qualms. We therefore call on working people everywhere to unite for a single political solution: the abolition of the global capitalist system and its replacement with one based on common ownership and production for use instead of for profit.

Intellectual Property: a further restriction on personal freedom (2006)

Guaranteeing corporate profits

The relation of intellectual property to personal freedom and its place in public and academic settings is an interesting topic with an interesting history.

The Uruguay Round that set up the World Trade Organization imposed what is called a free trade agreement, but which is, in fact, a highly protectionist agreement (the US and business leaders being strongly opposed to free trade and market economies, except in highly specific ways beneficial to them). A crucial part of this agreement was the establishment of very strong “intellectual property rights”. What this actually means is rights that guarantee monopoly pricing power to private tyrannies.

For example, consider a drug corporation. Most of their serious research and development – the hard part of it – is funded by the public. In fact, much of the dynamism of the world’s economy comes out of public expenditures through the state system, which is the source of most innovation and development. There is some research and development in the corporate system, but it’s mostly at the marketing end. And this is true of the drug industry. Once the corporations gain the benefit of the public paying the costs and taking the risks, they want to monopolize the profit and the intellectual property rights. These rights are not for small inventors. In fact, the people doing the work in the corporations don’t get much out of them; at best, they would receive a small bonus if they invent something. It’s the corporate tyrannies that are making the profits and they want to guarantee them.

The World Trade Organization proposed new, enhanced intellectual property rights – patent rights – far beyond anything that existed in the past. In fact, they are not only designed to maximize monopoly pricing and profit, but also to prevent development. For instance, the World Trade Organization rules introduced the concept of product patents. It used to be you could patent a process, but not the product, so if some smart guy could figure out a better way of producing something, he could do it. The WTO wants to block this. It’s important to block development and progress in order to ensure monopoly rights, so they now have product patents.

Consider US history: suppose the colonies, after independence, had been forced to accept this patent regime. What would we Americans be doing now? First of all, there would be very few of us at all, but those of us who would be here would be pursuing our comparative advantage in exporting fish and fur. That’s what economists tell you is right – pursue your comparative advantage. That was our comparative advantage. We certainly wouldn’t have had a textile industry. The British textiles were far cheaper and better. Actually, British textiles were cheaper and better because Britain had crushed Irish and Indian superior textile manufacturers and stolen their techniques. They therefore became the pre-eminent textile manufacturer, by force of course. In actuality, the US does have a textile industry which grew up around Massachusetts. But the only way it could develop was by extremely high tariffs which protected unviable US industries. Our textile industry developed and later had spin-offs into other industries. And so it continues.

We would never have had a steel industry either, for the same reason: British steel was far superior. One of the reasons is because they were stealing Indian techniques. British engineers were going to India to learn about steel-making well into the 19th century. They ran the country by force so they could take what the Indians knew and develop a steel industry. In order to develop its own steel industry, the US used massive government involvement through extremely high tariffs and the military system, as usual.

This system continues right up to the present, and furthermore it’s true of every single developed society. It’s one of the best-known truths of economic history that the only countries that developed are the ones that pursued these techniques. There were countries that were forced to adopt free trade and “liberalization” – the colonies – and they got destroyed. The sharp divide between the first and the third worlds has really taken shape since the 18th century. And maintaining this divide is what intellectual property rights are for. In fact, there’s a name for it in economic history: Friedrich List, the famous German political economist in the 19th century, who borrowed his major protectionist doctrines from Andrew Hamilton, called it “kicking away the ladder”. First you use state power and violence to develop, then you kick away those procedures so that other people can’t do it.

Intellectual property rights have very little to do with individual initiative. Einstein didn’t have any intellectual property rights on relativity theory. Science and innovation is carried out by people who are interested in it; that’s the way science works. However, there’s been an effort in very recent years to commercialize it, much the same way everything else has been commercialized. So you don’t do science because it’s exciting and challenging, because you want to find out something new, and because you want the world to benefit from it; you do it because maybe you can make some money out of it. You can make your own judgment about the moral value. Personally, I think it’s extremely cheapening, but also destructive of initiative and development.

It’s important to note that the profits from patents commonly don’t go back to the individual inventors. This is a very well-studied topic. Take, for example, the well-studied case of computer-controlled machine tools, which are now a fundamental component of the economy. There’s a very good study of this by David Noble, a leading political economist. What he discovered is that these techniques were invented by some small guy working in his garage somewhere in, I think, Michigan. After the MIT mechanical engineering department learned about it, they picked up these techniques and developed them and extended them and so on, and the corporations came and picked them up from MIT, and finally it became a core part of US industry. Well, what happened to the guy who invented it? He’s still probably working in his garage in Michigan or wherever it is. And that’s very typical.

I just don’t think intellectual property has much to do with innovation or independence. It has to do with protecting major concentrations of power which mostly got their power as a public gift, and making sure that they can maintain and expand their power. And these highly protectionist devices really have to be rammed down the public’s throat. They don’t make any economic sense or any other sense.

Neither do I think that intellectual property should play any role in academic and public institutions. In 1980 the Bayh-Dole Act gave universities the right to patent inventions that came out of their own research. But nothing comes strictly out of a university’s own research; it comes out of public funding. That’s how the university can function; that’s how their research projects work. The whole system is set up to socialize cost and risk to the general public, and then within that context, things can be invented. But I don’t think universities should patent them. They should be working for the public good, and that means the fruits of their research should be available to the public.

No amount of legislation can change the basics
To most people today, the notion that ideas or information can be owned seems as natural as owning a house or a bicycle. We are brought up to believe that when someone writes a book or piece of music, or develops plans for a new invention, they become that work’s sole owner. This means that they alone have the right to determine whether and how that work is used by other people, or the right to transfer ownership of the work to another person or a company. Only the owner is allowed to make and sell copies of the work, to incorporate it into a collection of other works, or to produce a new work based on the original, such as a new edition or a sequel. These “rights”, as they are called, are encoded not just in our laws, but increasingly, as we shall see, in our social norms and our technology.

However, the world did not always work this way. To people in the Ancient world and in Mediaeval times, the thought that anyone could claim ownership and control of something intangible like a poem or an idea would have seemed ludicrous. Philosophers and mathematicians regularly borrowed, critiqued, and expanded upon the works of their colleagues; historians compiled and summarized descriptions of events recorded by others; and musicians performed existing songs while adding their own embellishments. Written works were copied freely (albeit laboriously) by trained scribes, and technological improvements diffused gradually among artisans through word of mouth.

To someone from the past, then, today’s intellectual property regime would seem terribly restrictive. Had Shakespeare been told he could not copy and rework material from other playwrights, he would have seen this as a tyrannical imposition on his personal freedom as an artist. What’s more, we would have been robbed of many of his greatest works, including Hamlet and King Lear, both of which were adaptations of other authors’ plays. What was it that changed, then, between Shakespeare’s time and ours, to allow us to think of information and ideas in the same terms as physical property? And more importantly, is our society more or less free as a result?

The answer to the first question is relatively simple when we look at things in their historical context. In the century preceding Shakespeare, two great developments began sweeping across Europe, one technological, the other socio-economical. The first of these was mechanized printing, introduced by Johannes Gutenberg in the 1450s. Books and pamphlets suddenly became easy and cheap to reproduce, and with their abundance literacy and authorship increased. The second development was the capitalist mode of production, which was by fits and starts beginning to replace the old feudal system. Trained scribes who used their own inexpensive tools for copying manuscripts were replaced by relatively unskilled workers who operated a costly printing press owned by their employer. Few authors could afford a press to print their own books, and the wealthy publishers who owned the presses depended on a steady supply of new literature to drive their sales. Therefore, authors and publishers entered into an agreement whereby the publisher supported the author financially in exchange for printing their book and retaining the profits from its sale.

Though a few popular authors became quite wealthy through this arrangement, the vast majority were not significantly better off than the rest of the labouring class. As with any employment relationship, it was not in the publisher’s interest to pay authors any more than required for their upkeep, thus forcing them to either continue writing or seek other employment. To prevent authors from securing payment from more than one publisher simultaneously and to prevent rival publishers from cutting into their profits, publishers in the 17th and 18th centuries pressured governments to enact laws recognizing a publisher’s exclusive ownership and control (“copyright”) of a literary work. (Initially this ownership rested with the author, though as it was useless to anyone without a press, he invariably assigned it to a publisher.) Similar laws were enacted granting monopolies on “any manner of new manufactures” – that is, patents – which again were beneficial primarily to those who already had the capital to exploit and defend them.

For professional writers, artists, and inventors, then, copyrights and patents – collectively referred to as “intellectual property” – are simply a specialized legal formalization of the wage-labour exchange other workers are forced to make with their employers. Just as manual labourers, lacking the means to produce and distribute their own products, must sell their labour power to a factory owner for an hourly wage, writers, lacking a printing press and bookstore, sell the copyright on their writing to a publishing house for a lump sum or nominal royalty. And just as manual labourers selling their labour power must waive ownership of the goods they have produced and the freedom to use them as they see fit, so too do writers selling their copyright lose the freedom to use their writing as they wishes. If a writer wishes to adapt or incorporate elements of another book – even one that they themself originally wrote – into a new work, they must first secure (and often pay for) permission from the publisher who owns the copyright. Given that the free and fruitful exchange of ideas and information was commonplace before intellectual property, it is difficult to argue that these laws have done anything other than rob artists and scientists of their personal freedom to learn from and interact with each other.

And what of the rest of us, those of us who do not make our livings writing, performing, or inventing? Has the intellectual property regime affected us in any way? Until relatively recently, the answer was not much, or at least, not personally. Intellectual property was simply a legal fiction allowing corporations to stake their various claims to “properties” in the information market. How the capitalists decided amongst themselves who had the right to produce what had little bearing on the individual freedom of the average worker, who owned neither presses to print books nor factories to mass-produce new machines . Technically it was illegal for a worker to make a copy of a book, but since it would take them weeks or months to do so by hand, the publishers’ profits were not threatened and no injunction was sought.

With the advent of home computers and the Internet, however, the entire working class suddenly found itself in possession of the same sorts of instruments of production and distribution that had previously been exclusive to wealthy publishing houses. Once a book or piece of music had been put into digital form, anyone could instantly produce unlimited copies with the click of a button and instantly send them anywhere in the world. Alarmed at the threat to their monopolies and their profits, publishers began to take notice. Criminal and civil lawsuits were brought against individuals who downloaded music from the Internet or copied software for their friends. Publishers launched wide-scale public “education” campaigns to convince people that unauthorized copying was akin to theft or even to piracy on the high seas. The full force of the law and corporate propaganda apparatus was applied to preventing workers from exercising their new-found ability to produce and distribute intellectual property on a massive scale.

At this point, one could well argue that people technically had not lost any of their personal freedoms, since by law they were never free to copy information in the first place. This changed, as Noam Chomsky notes, with the passing of increasingly restrictive laws in the late 20th century. Now it is a crime not just to copy a digital work, but also to use it in any way not authorized by the publisher. Many of the freedoms people enjoyed with printed books and analogue audio and video recordings no longer apply to their digital counterparts. A publisher can arbitrarily decide that a particular e-book can be read only a certain number of times, or only up to a certain date, or only on a certain device, making transfer to a friend or donation to a library impossible. These restrictions are hard-coded into the device or software which reads the e-book, and modifying the software or inventing a new device to circumvent these restrictions is a criminal offence.

In conclusion, Prof. Chomsky is correct in his identification of today’s intellectual property system as a way of granting legal monopolies to corporations. And I applaud him for speaking out against the worst excesses of companies exploiting the patent system in the name of maximizing profits. But by focussing on and attacking only recent intellectual property law reforms, it is easy to fall into the trap of suggesting that the system could be “fixed” simply by repealing these reforms or otherwise tweaking the laws. As I hope I have shown here, from their very beginnings copyrights and patents have existed to benefit only that small minority of people who owned the presses, warehouses, and stores through which books and other media are reproduced and distributed. Any benefit to the inventors and authors who actually produce inventions and artistic works is incidental, and furthermore comes at the cost of stifling cross-pollination of ideas and the progress it entails. No amount of legislation can ever change the fundamental relationship in production between the workers, who produce almost all of the world’s artistic and scientific wealth, and the rich minority who control the means of disseminating this wealth. Therefore workers have no stake in the intellectual property regime and should work only for the abolition of the entire system that supports it.
